These Terms and Conditions (“Terms”) govern your access to and use of our services, including our communications via WhatsApp, RCS (Rich Communication Services), calls, messages, and any related offline or digital channels operated under our brand.
By engaging with Samarth Developers—whether for property consultation, project development, construction, or real estate collaboration—you agree to abide by these Terms.

These Terms constitute a legally binding agreement between you (“Client,” “User,” or “Customer”) and Samarth Developers, governed by the laws of India.

2. Definitions

  • “Business” refers to Samarth Developers, a proprietorship offering real estate development and property construction services.
  • “User” or “Client” means any person who communicates, contracts, or avails services from Samarth Developers.
  • “Services” include property development, construction, architectural coordination, civil work, consultancy, and related communication through WhatsApp or RCS.
  • “Content” means all information shared via digital or printed formats, including designs, quotations, proposals, or messages.
  • “Agreement” means these Terms, including any amendments.

3. Acceptance of Terms

By accessing or using our services or communicating through WhatsApp, RCS, or other channels, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree, you must discontinue all communications and services immediately.

4. Description of Services

Samarth Developers provides:

  • Real Estate Development: Residential and commercial project planning and execution.
  • Construction Services: Civil, structural, and architectural contracting.
  • Property Consultancy: Assistance in site selection, design coordination, and development.
  • Client Communication: Official updates, quotations, and progress reports via WhatsApp or RCS as approved communication platforms.

All services are offered in compliance with Indian construction and real estate laws.

5. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under Indian law.
If you are representing an organization, you must have proper authorization to act on its behalf.

6. Account Registration

For digital interactions, Samarth Developers may collect limited personal details (such as name, email, contact number, and project requirements) to manage your requests.
You agree to provide accurate information and notify us promptly of any updates.

7. User Responsibilities

  • Provide correct and lawful project-related information.
  • Do not misuse our communication channels for spam, harassment, or fraudulent activities.
  • Respect all intellectual property shared during project discussions.
  • Avoid sharing any confidential designs or proposals publicly without written consent.

8. Payment & Billing Terms

All payments for services or project stages must be made via approved channels such as bank transfer, UPI, or digital payments.
Invoices will clearly indicate project scope, material costs, and service charges.
Late payments may attract interest as per agreement.
All payments are non-refundable, except in cases explicitly agreed in writing.

9. Subscription Renewal & Termination

Since Samarth Developers operates on a project-based service model, renewals apply only to continuing projects or maintenance contracts.
Either party may terminate an agreement by providing written notice. Upon termination, pending payments for completed work must be settled.

10. Use of WhatsApp Official API & RCS

Samarth Developers may communicate with clients through Meta’s WhatsApp Business API and Google’s RCS messaging platform for:

  • Project updates
  • Appointment confirmations
  • Billing and payment reminders
  • Customer support

By engaging with us on these platforms, you consent to receive such communications. All communications will comply with the Meta Business Policy and Telecom Regulatory Authority of India (TRAI) messaging norms.

11. Message Delivery & Compliance Policy

We ensure that all digital messages sent via WhatsApp or RCS are in compliance with TRAI and Meta platform guidelines.
Users shall not misuse our communication channels for unsolicited messages or unauthorized sharing.
Any abuse of our official messaging channels may lead to termination of services.

12. Intellectual Property Rights

All project plans, blueprints, layouts, and communication materials shared by Samarth Developers are the exclusive property of the business.
Clients may not copy, distribute, or reuse any materials without written consent.
Use of our logo, brand name, or identity requires explicit authorization.

13. Confidentiality

Both parties agree to keep confidential all project-related and client-related data, including personal contact information, drawings, or business strategies.
Confidential information shall not be disclosed unless required by law or regulatory authority.

14. Disclaimer of Warranties

Samarth Developers provides services “as available” and “as agreed” for each project.
We make no express or implied warranties regarding:

  • Continuous availability of communication platforms (WhatsApp/RCS).
  • Uninterrupted project timelines due to third-party dependencies or regulatory delays.

15. Limitation of Liability

In no event shall Samarth Developers, its owner, or employees be liable for any indirect, incidental, or consequential damages arising from:

  • Project delays caused by government permissions, supply chain issues, or third-party vendors.
  • Technical issues with messaging or digital communication.
  • Misinterpretation of any content shared digitally.

Our total liability is limited to the amount paid by the client for the specific project stage concerned.

16. Indemnification

You agree to indemnify and hold harmless Samarth Developers, its owner, employees, and contractors from any claims, damages, or losses arising from:

  • Breach of these Terms
  • Misuse of communication channels
  • Violation of intellectual property rights

17. Governing Law (India)

These Terms are governed by and construed in accordance with the laws of India, subject to the exclusive jurisdiction of the courts of Nashik, Maharashtra.

18. Changes to Terms

Samarth Developers reserves the right to modify or update these Terms from time to time. Updates will be communicated through email, WhatsApp, or on our official business listing page. Continued use of services after such updates constitutes acceptance.
